Technical Questions: Answered Plainly

What is OLV and how is it different from FLV?

OLV (Orderly Liquidation Value) is the expected proceeds from a well-organized, marketed sale with adequate time: typically 90–180 days. FLV (Forced Liquidation Value) is the expected proceeds from a constrained, time-limited sale: typically 30–60 days. Lenders underwrite to OLV; FLV is used for worst-case exposure modeling. KD provides both, USPAP-compliant, from AMEA-certified appraisers.

What does "commercially reasonable" mean under UCC Article 9?

Under UCC § 9-627, a disposition is commercially reasonable if conducted in a recognized market, at current market prices, or in conformity with reasonable commercial practices. Engaging an established auctioneer (like KD) with a documented buyer network and marketing record is the standard method of satisfying this requirement. We document every step of the process.

What is a 363 sale and how does KD handle it?

A 363 sale (under 11 U.S.C. § 363) is a court-approved sale of bankruptcy estate assets, free and clear of liens. KD serves as the auctioneer (managing appraisal, marketing, auction execution, and settlement) while your counsel handles the motion practice and court approval. We have experience operating under court-approved bid procedures.

How quickly can you provide an appraisal for a court filing?

Rush appraisals are available for court and lender deadlines. We can typically deliver a desktop appraisal within 3–5 business days. On-site appraisals typically deliver in 2–4 weeks, with expedited 5–10 business day turnaround available for court and credit deadlines. Contact us directly at 480.455.3910 for emergency timelines.

Do you provide settlement accounting acceptable for court records?

Yes. Every engagement includes a complete per-lot settlement report documenting gross proceeds, buyer's premium collected, all expense deductions, and net proceeds to the estate. Reports are delivered in a format suitable for court filings and lender credit files.

Are you licensed and bonded?

Yes, KD Auctions holds auctioneer licenses in applicable jurisdictions, carries professional liability and errors & omissions insurance, and is bonded. AMEA-certified appraisers carry their own professional liability coverage. Credentials and insurance documentation are available upon request.
